These Terms of Service ("Terms") govern the use of services provided by MARQ, a design subscription agency based in Portugal.
By subscribing to or using our services, you agree to be bound by these Terms.
1. Services
MARQ provides design services on a subscription basis, allowing clients to submit unlimited design requests for a flat monthly fee. Deliverables are completed sequentially, not concurrently, unless otherwise specified in the subscribed plan.
2. Subscription and Billing
Subscriptions are billed on a monthly recurring basis.
Fees are payable in advance.
All payments are final. No refunds are provided under any circumstances, including unused time or dissatisfaction with delivered work.
3. Client Responsibilities
Clients agree to:
Provide clear, accurate, and lawful design requests
Respond in a timely manner to feedback and approvals
Ensure they hold all necessary rights to materials supplied to MARQ
4. Intellectual Property
Upon full payment of the applicable subscription fees, the client is granted all intellectual property rights to the final, delivered design assets, except for:
Third-party assets subject to separate licenses
MARQ pre-existing materials, methods, or know-how
MARQ reserves the right to showcase completed work in its portfolio unless otherwise agreed in writing.
5. Turnaround Times
Turnaround times are estimates only and depend on request complexity, queue size, and client responsiveness. No guarantees are made regarding delivery timelines.
6. Fair Use Policy
Unlimited requests are subject to a fair use policy. MARQ reserves the right to limit or pause services if usage is deemed excessive or abusive relative to standard operational capacity.
7. Termination
Either party may cancel the subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds or credits will be issued.
MARQ reserves the right to suspend or terminate services immediately in cases of misuse, non-payment, or violation of these Terms.
8. Disclaimer of Warranties
Services are provided on an "as is" and "as available" basis. MARQ makes no warranties, express or implied, regarding fitness for a particular purpose or uninterrupted availability.
9. Limitation of Liability
To the maximum extent permitted by law, MARQ shall not be liable for indirect, incidental, consequential, or special damages. MARQ’s total liability shall not exceed the amount paid by the client in the one (1) month preceding the claim.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the Portuguese courts.
11. Changes to the Terms
MARQ may modify these Terms at any time. Continued use of the services constitutes acceptance of the updated Terms.
